But the Founders created a constitutional federal republic characterized by checks and balances and a central government with constitutionally limited powers, and did so precisely to safequard the autonomy of the states and protect the fundamental rights and liberties of individual Americans from the whims of the masses, to guard against the excesses of democracy, to prevent majoritarian tyranny.”
